Unfortunately even we cannot do without small print. After all, we are dealing with sophisticated and sensitive works of art.
First of all we would like to point out that pictures are always subject to environmental influences; their appearance and colour can change and fade. To ensure that you can continue to enjoy our works of art, do not expose photos, laminates or frames in whole or in part to direct sunlight, do not hang them directly over heating appliances and do not expose them to higher humidity than is usual in a normal living room. Photos, laminates and frames are therefore not suitable for outdoor areas, basements, bathrooms or kitchens. Laminates with UV protection film or acrylic glass and wooden frames are very sensitive to scratches and dirt and should therefore only be handled with gloves or equivalent protection.
Our general terms and conditions have been drawn up to govern the business relationship between you and us and are intended to be both binding and fair. The basis for any order or contract is therefore always the following Terms and Conditions of Wallcoverart.com in Geleen, and you acknowledge and confirm that you are aware of these terms and conditions and agree to their application when placing an order with us. Article 1: Applicability
For the business relationship between Wallcoverart.com, Geleen, here acting under the brand name Wallcoverart.com and the purchaser the following Terms and Conditions apply exclusively in their most current version at the time of order. Deviating terms and conditions of the purchaser are not recognised by us unless Wallcoverart.com has expressly agreed to them in writing.
Article 2: Conclusion of contract
The display of products in the online shop does not constitute a legally binding offer; it is merely an online catalogue without obligation. The products that you have selected by clicking on the “Add to basket” button are summarised again for you at the end of the ordering process in an order summary. Here you can check the various details you have provided during the ordering process and complete or correct them by clicking on the “Edit” button. By clicking on the button “Buy now” you send your order data and make a binding declaration to Wallcoverart.com that you want to buy the products mentioned there (Offer). We accept your offer automatically after receipt of your order. Immediately after submitting the order you will receive an email with an order and contract confirmation, in which the details of your order are listed again.
The text of your order is stored by us and can be sent to you upon request after completion of your order. For your own protection Wallcoverart.com recommends to print out the order details and the General Conditions applicable at the time of ordering. The contractual language is English.
We would like to point out that we sell all products only in small quantities.
Information on cancellation
Right of cancellation
You have the right to cancel this contract without giving reasons within 5 working days.
The right of cancellation applies 30 days from:
- A) The day on which you – or a third party designated by you and who is not the shipping service – take delivery of the goods, if you have ordered one item or several items in one order, and the item(s) arrive in one go
or
- B) The day on which you – or a third party nominated by you and who is not the shipping service – take delivery of the final goods, in the event that several items from one order are shipped separately.

The deadline for the right of cancellation will be met as long as your declaration that you are exercising the right of cancellation is sent within the allotted cancellation period.
Cancellation terms and procedure
If you cancel the purchase contract, we will refund immediately all payments received from you, including shipping costs (except for any extra costs incurred by choosing a type of delivery other than the standard, low-cost delivery offered by us), at the latest within 30 days of receipt of the statement indicating your cancellation. Refunds will be made to the original method of payment, unless expressly agreed otherwise. We may withhold reimbursement until we have received the returned goods or you have provided proof of return, whichever occurs first. You must return the goods in their original packaging without delay. They must be returned no later than 30 days from the day you notify us of the cancellation. This deadline is met as long as the return is sent within the allotted 30 days.
You will bear the direct costs of the return shipment. Generally, goods cannot be returned by normal post. Please contact our customer service for more information.
You are only responsible for any diminished value of goods if, after inspection of their condition, properties and functionality, the diminished value can be traced back to your improper handling of the goods.
Cancellation information Section 3: Cancellation
Please note that works of art with a customised mounting/framing (“choose a customised presentation”) as well as unmounted/framed photo prints are excluded from the right of cancellation, as they are customised according to your individual specifications. Customised products are excluded from the right of withdrawal according to the Dutch Civil Code.
Article 4: Delivery
Unless otherwise agreed, delivery will be made ex warehouse to your address or to the delivery address you provide. The delivery time is approx. 14 working days.
Article 5: Artwork certificate with signature
For organisational reasons Wallcoverart.com can also send the Edition Certificate with signature of the artist and the edition data separately – and with delay – to the orderer. In this case the cancellation period will only commence after receipt of the artwork certificate
Artwork certificate with signature. If you exercise your right of cancellation, you must also immediately return the unused Artwork Certificate. Without receipt of the Artwork Certificate, the purchase price will not be refunded. The right of withdrawal expires if the Artwork Certificate is used on the artwork, the frame, the lamination or elsewhere.
Article 6: Prices, due date and payment, default
The prices stated in the online shop are final prices including turnover tax. Shipping costs are included in the price. The purchase price is paid by credit card. Please note that direct debit is only possible with a Dutch bank account. You can pay via PayPal or credit card (Visa, Mastercard, American Express).
If the account of the purchaser has insufficient balance or the purchaser opposes the bank transfer without a valid reason, Wallcoverart.com has the right to demand an amount of € 5.00 for administration costs from the purchaser.
In case of default, Wallcoverart.com reserves the right to charge consumers a default interest of 5 percentage points above the respective base rate per year as published by the European Central Bank and to charge companies 9 percentage points above the respective base rate per year as published by the European Central Bank. In addition Wallcoverart.com can charge a fixed rate of € 2.50 per reminder, except for the first reminder. If as a result of these arrears a demonstrably higher cost arises, Wallcoverart.com reserves the right to make claims in this respect.
In the above cases you have the right to prove that in reality no costs were incurred by Wallcoverart.com or that these costs were lower than the above mentioned flat fees.
Article 7: Guarantee
Unless explicitly agreed otherwise, the statutory warranty rights apply.
The statutory guarantee period of two years shall apply. This begins with the handover of the goods. During this period, all defects covered by the statutory warranty shall be remedied free of charge.
If, as the buyer, you are a business in the sense of the word “enterprise”, your claims for defects shall require that you have fulfilled your statutory duty to investigate and complain. If a defect is discovered during the inspection or later, we must be informed immediately. Immediate is in this case when you inform us within two weeks, whereby the timely dispatch of the notification is sufficient to meet the deadline. Regardless of this obligation to inspect and complain, you must notify us in writing of apparent defects (including incorrect or short deliveries) within two weeks of delivery, whereby the timely dispatch of the notification is sufficient to meet the deadline. If you fail to carry out a proper inspection and/or notify us of the defect, our liability for the defect that has not been reported is excluded.
Article 8: No grant of rights
By purchasing a photographic print, you acquire only the material ownership of the print. No other rights are granted or implied. Any reproduction (copying), distribution, rental, public exhibition or other analogue or digital use is not permitted, unless permitted by law. You can, however, resell the print.
